The Algorithm Doesn’t Care, But Should It?

Imagine a self-driving car barreling toward an unavoidable accident. On the left, a group of pedestrians. On the right, a wall that would likely kill the driver. The car must be chosen. Who writes that decision? And who takes responsibility when it goes wrong?

This isn’t science fiction anymore, it’s a real ethical dilemma faced by developers, ethicists, and policymakers. Unlike humans, AI doesn’t have empathy. It doesn’t feel guilty. Its decision-making process is the sum of probabilities, training data, and lines of code.

The paradox is that we are empowering decision-making authority into systems that are lacking the characteristics that define moral conduct. These qualities—morality, context, and intuition—are fundamentally human. Is it possible to encode them? If not, should life-or-death situations ever be trusted to AI?

When we allow machines to decide without fully understanding how they decide, we risk building a future that is dangerously efficient and devastatingly indifferent.

Bias: The Ghost in the Machine

One of AI’s most persistent issues isn’t just what it does, it’s how it does it.

In 2018, a major tech company’s AI recruitment tool was found to be biased against women.  It had been trained on ten years of resumes submitted to the company, most of which came from men. The AI learned that being male was correlated with being employable. 

This is the ethical equivalent of a ghost in the machine, a haunting reminder that AI inherits the flaws of its creators. The data we feed it isn’t neutral, and without careful oversight, AI systems can boost societal biases rather than eliminate them.

And in high-stakes sectors like healthcare, law enforcement, and banking, these biases aren’t just offensive, they’re dangerous. They can mean a patient goes undiagnosed, an innocent person is wrongly flagged, or a qualified candidate never gets the job.

We often think of AI as objective, but objectivity is a myth if the inputs are tainted. And in the age of machine learning, the bias doesn’t just persist, it scales.

The Surveillance Dilemma: Watching the Watchers

AI-driven facial recognition can unlock your phone. But it can also track protestors, monitor neighborhoods, and even predict potential crimes before they happen. It’s the ultimate double-edged sword.

China’s extensive use of AI surveillance to monitor citizens and suppress dissent is often cited as a cautionary tale. But Western democracies are not immune. In the name of safety, privacy is increasingly being traded for convenience, and often without our clear consent.

Your face is your identity. Yet in many places, it can be scanned, logged, and stored by cameras you didn’t know were watching. And unlike passwords, you can’t change your face.

Should we allow governments and corporations to scan our faces, read our movements, and map our behaviors? And who ensures these powers aren’t misused?

Once monitoring becomes normalized, reversing it is nearly impossible. That’s why ethical boundaries must be set before the technology is fully entrenched, not after it’s abused.

Who Owns Your Digital Doppelgänger?

With generative AI, creating a digital clone is child’s play. Voice, appearance, even writing style, everything can be mimicked with alarming accuracy. This raises fascinating but chilling questions: Who owns your likeness? Your voice? Your soul, in a digital sense?

Actors and musicians are already fighting to retain control over their digital selves. In one famous case, a deceased celebrity was brought back to life in a commercial via deepfake. 

But this issue goes beyond celebrities. Imagine your voice being used in a scam, or your face appearing in a video you never filmed. The ethical lines around consent, legacy, and identity are rapidly blurring in this new digital dimension.

Your online self may outlive you, but will it still be you?

As AI-generated content floods the internet, we’re entering a post-truth era where seeing is no longer believing. That shift demands urgent action, not just in law, but in literacy.

Autonomy vs. Control: The Responsibility Gap

Let’s return to the self-driving vehicle. Who will be responsible if it crashes? The engineer who develops software? The automaker? The algorithm itself?

The responsibility gap, as defined by ethicists, becomes increasingly apparent the more we automate. Traditionally, people are held responsible for their decisions. However, it becomes difficult to determine fairness or responsibility when machines make those decisions.

Justice is important, though. There must be restitution if AI wrongfully accuses someone of a crime, refuses to loan them money, or harms them. The law, which has recently fallen behind, needs to change to close these moral gaps.  

Having distinct lines of authority is crucial for trust as well as legal reasons. Because everyone is at risk if no one is held responsible.

The Temptation of God Mode

Perhaps the most seductive, and dangerous, aspect of AI is the illusion of omnipotence. With enough data, we believe we can predict anything: crime, illness, behavior, even love.

But reducing human complexity to patterns risks stripping away the nuance that makes us… us.

Predictive policing, for instance, might flag someone as a potential offender based on their environment or history. But what about free will? Growth? Redemption?

When we treat people as datasets, we risk forgetting their humanity. AI can help us understand the world, but it must never replace the messy, beautiful, unpredictable reality of being human.

Data can inform decisions but it cannot define identity.

The Need for Ethical Design

We don’t stop building AI. That’s neither possible nor wise. But we must build with intention. With foresight. With humility.

Ethical AI isn’t about making machines moral, it’s about making humans more responsible for how we design, deploy, and regulate those machines.

This means:

  • Transparency: AI systems must be explainable, not black boxes.
  • Accountability: There must be clear lines of responsibility.
  • Inclusivity: Diverse voices must shape the data and design.
  • Privacy: Users should control their data, not the other way around.
  • Regulation: Laws must evolve to protect citizens from both malicious and unintended consequences.

Instead of being a post-launch fix, ethics must be a design element.

The Mirror and the Machine

Beyond simply being an engineering marvel, artificial intelligence is a mirror of our humanity. We incorporate elements of our beliefs, presumptions, and intents into each algorithm. This implies that the moral conundrums that AI presents are fundamentally human.

Will we create systems that equitably benefit everyone or ones that covertly maintain historical biases? Will AI be used to automate inequality or to increase opportunity? We cannot rely just on the programming to make these decisions. We must make these decisions consciously, openly, and cooperatively.

AI is neither good nor evil. It’s strong. And the future of society as a whole, along with the future of technology, will be determined by how we manage that power.
