Artificial intelligence (AI) music can help with several areas of music creation, including creating a song from scratch, writing certain parts of a composition, mixing and mastering a production, voice cloning, and more.

Copyright and AI Music

Who profits from an AI-created piece is one of the most hotly contested topics in the music industry, particularly if the algorithm was trained on previously published protected content. The U.S. Copyright Office initiated an investigation into copyright concerns related to artificial intelligence in March 2023. Although Camp is optimistic that regulators will intervene to provide a patch, he is worried that the US copyright structure that artists operate under will make the problem difficult to resolve.

“The series of laws and precedents that ended up with our modern copyright system just do not fit with what’s going on in music right now,” says Camp. “I do think that creators should have attribution and should be credited and should receive compensation. But again, the whole system that we’re doing this through is way outdated.”

The use of AI in music is still mostly unregulated legally, which brings the question of whether it is possible to find a balance between limiting the potential for musical innovation utilizing AI technology and providing artists with fair credit, compensation, and consent for their work or likeness to be utilized for AI. work is, to some extent, a derivative of other work, and at the moment it’s difficult to tell what is stealing and what is inspiration. A few record labels are beginning to retaliate. 

Drake and The Weeknd

Although voice cloning hasn’t been legally precedent much, for celebrities it might be considered a breach of their right to publicity because it appropriates their name, likeness, and voice. One of the most notable instances from the previous year was when a TikToker going by the handle Ghostwriter created a fictitious Drake and The Weeknd duet called “Heart on My Sleeve” using AI. Although the song was removed from the air, variations of it can still be found online.

According to Wares, “one could argue that this is an original work.” However, since the AI discovered how to create songs in Drake’s manner by studying his catalog without getting his consent, this can be seen as a type of violation. Unauthorized use of the names and likenesses of the artists is another problem.

The music industry, along with the entertainment industry at large, is concerned about the possibility of utilizing AI to reproduce someone’s name and likeness. Protecting authors from having their writing used to train AI generators and performers from having their voices and images perpetually repeated without permission are two of the main demands of the current SAG-AFTRA strike. 

AI Ethical Issues

AI raises a number of ethical questions, copyright being only one of them. It’s crucial to keep in mind that there are implications to this technology’s development.

Bias in training data sets is one of the current issues. AI musician FN Meka is one example; he was signed to Capitol Music Group in 2022 but was later fired for spreading racial stereotypes. 

There are drawbacks to this data monitoring as well. The “reinforcement learning” training method, which includes giving human feedback for a variety of upsetting content, raises further ethical questions. The Wall Street Journal’s The Journal podcast recently featured a Kenyan data worker who, among many others, assisted in teaching ChatGPT “right from wrong” at a very significant cost to mental health. 

According to Camp, “this basically involves giving the answers a thumbs up or down.” “Is this a suitable response? Is this excessively graphic, violent, or unsettling? Kenyans are being paid $2 per hour by OpenAI to sift through these responses as part of a contract. Imagine being paid $2 per hour to read some of the most horrifying and psychologically upsetting texts for ten hours at work. After that, you go home, and all of that stays in your head. Thus, there are numerous drawbacks to the current method of making sausage.

Camp provides an example of collaborating with Julia Perry, a Berklee alumna who conducted an interview with them for a Berklee Now piece concerning AI and music, to come up with some song ideas using ChatGPT.

“We were discussing the enchantment of the universe and her desire to convey this profound, unknown reality about it,” Camp recalls. “And I basically gave ChatGPT 20 opening lines for this song, info-dumping everything she said into two or three paragraphs.”

In the end, they started a new song by riffing on one of the twenty options.
